    1. Acceptance of Terms

    By accessing or using the 3dopenwebsite.com website ("the Site"), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you must not use our website or services. The Site and the services described here are provided by "3D OPEN DESIGN" Ltd (3 Д ОУПЪН ДИЗАЙН ЕООД), UIC 207665677, with registered office at 1 Chukar Str., Vitosha district, 1616 Sofia, Bulgaria ("3dopenwebsite.com", "we", "us"), under EU and Bulgarian law.

    2. Description of Services

    3dopenwebsite.com offers professional web design, web development, SEO optimization, brand strategy, content creation, social media marketing, and related digital services. Our services are tailored for individuals and companies seeking a strong digital presence across Europe and worldwide.

    The specific scope, deliverables, timeline, and pricing for each project are defined in a separate project agreement or proposal provided to the client. These Terms of Use govern the use of our website, while project-specific terms are governed by the applicable service agreement.

    3. Intellectual Property Rights

    3.1 Our Intellectual Property

    All content on this website — including text, graphics, logos, design elements, code, and software — is the property of 3dopenwebsite.com or its licensors and is protected by applicable intellectual property and copyright laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

    3.2 Client Intellectual Property

    Upon full payment for services, clients retain full ownership of their website content, images, and brand materials. 3dopenwebsite.com retains the right to display completed projects in its portfolio unless otherwise agreed in writing.

    4. User Responsibilities

    When using our website or services, you agree to:

    Our professional web design services are offered at fixed, transparent pricing as published on our website. All prices are in Euros (EUR) and are one-time payments for the initial build unless otherwise specified.

    Payment terms, including deposit schedules and final payment milestones, are outlined in each project agreement. Late payments may result in project delays or suspension of services.

    6. Project Timeline and Delivery

    Project timelines are estimated based on the scope of work defined in the project agreement. Individual websites typically require 2-3 weeks, and company websites typically require 3-5 weeks. Delays may occur due to client feedback cycles, third-party dependencies, or unforeseen circumstances. We commit to transparent communication throughout the project lifecycle.

    7. Domain Name Registration

    These terms apply when you buy a domain name on 3dopenwebsite.com. They add to the rest of these Terms and, where the two differ, take precedence for domain names.

    7.1 Who registers your domain

    We act as a reseller of Openprovider (Hosting Concepts B.V., the Netherlands), an ICANN-accredited registrar. Your domain is registered in your name, with the details you give at checkout: you are the registrant and the holder of the domain, and we never register it in our own name. Each domain ending is run by a registry whose policies also apply to your registration, and you agree to follow them.

    As a registrant you have the rights and responsibilities set out by ICANN in the Registrants' Benefits and Responsibilities and the Registrant Educational Information.

    7.2 Your details and email verification

    Registries and ICANN require the registrant's name, address, phone number and email to be accurate, complete and kept up to date. Please tell us of any change. For generic endings such as .com, .net, .org, .dev and .app, the registrar emails you a link to confirm your email address; if it is not confirmed within 15 days, the domain is suspended until you confirm it. A domain registered with false details can be suspended or cancelled by the registry.

    7.3 Price, payment and start of registration

    The price shown before payment is the price for the registration period you choose. Payment is taken by Stripe. Registration starts immediately after payment and most domains are active within minutes; some endings need a registry review that can take longer.

    7.4 Right of withdrawal

    If you are a consumer in the EU you normally have 14 days to withdraw from an online purchase. A domain registration is carried out in full at your express request straight after payment and cannot be undone, so your right of withdrawal ends once the domain is registered (Article 16(a) of Directive 2011/83/EU). You confirm this at checkout before you pay.

    7.5 Refunds

    If the registry refuses the name or the registration fails, you receive a full refund to your original payment method. Once a domain has been registered, registries do not refund the fee, so neither can we.

    7.6 Renewal and expiry

    Domains do not renew automatically. A registration lasts for the period you paid for. We email the registrant 30, 14 and 3 days before it ends with the renewal price and a link to renew online, and the domain is renewed only once you have paid. For generic endings you will also receive the expiry notices ICANN requires at the registrant email address. If a domain is not renewed it expires; most endings then allow a short period in which it can still be restored, often for an extra fee set by the registry, after which it is deleted and anyone may register it.

    7.7 Privacy in the domain registry

    Where the ending allows it, you can choose WHOIS privacy at checkout to keep your name, address and phone number out of the public registry lookup. Registrant data is processed as described in our Privacy Policy, and registries and registrars may disclose it where the law or their policies require.

    7.8 Moving your domain

    The domain is yours and you may transfer it to another registrar. On request we provide the transfer authorisation code free of charge. Registry rules may block a transfer for a period after registration or after a previous transfer (for generic endings, 60 days).

    7.9 Disputes, abuse and suspension

    Disputes over the right to a domain name are decided under the registry's dispute policy — for generic endings, ICANN's Uniform Domain-Name Dispute-Resolution Policy (UDRP). We, the registrar or the registry may suspend a domain used for unlawful activity, abuse such as spam, phishing or malware, or registered with false details.

    7.10 Endings registered by hand

    Some endings, such as .bg, need documents or local presence. These are not sold at checkout; we register them for you on request after the registry's requirements are met, with the price agreed in advance.

    8. Additional Services Bought Online

    These terms apply when you pay online for a package of additional services on 3dopenwebsite.com (for example brand assets, email setup, articles or print design). They add to the rest of these Terms and, where the two differ, take precedence for those purchases.

    8.1 What you buy

    You buy the services listed at checkout, in the quantities shown, at the fixed prices shown. Only services with a fixed price can be paid online; services with a starting price, a monthly fee or a custom quote, and domain names, are agreed separately. Services marked as coming soon are recorded as your interest in early access and are not charged.

    8.2 Payment and start

    Payment is taken by Stripe. Within one working day of payment we contact you at the email you gave to collect what we need (your brand, texts, logins or print details) and agree the delivery dates. Work starts once we have that information. Printing, licences and other third-party costs that are not listed at checkout are quoted to you separately before they are incurred.

    8.3 Right of withdrawal

    If you are a consumer in the EU you may withdraw from the purchase within 14 days of payment without giving a reason, by telling us by email. If you asked us to start work within those 14 days and you withdraw, you pay for the work done up to that point, in proportion to the whole. Once a service has been fully performed at your express request, your right of withdrawal for it ends (Article 16(a) of Directive 2011/83/EU). You confirm this at checkout before you pay.

    8.4 Refunds

    A withdrawal is refunded within 14 days to your original payment method, less the value of work already done. If we cannot deliver a service you paid for, you receive a full refund for that service.

    9. Limitation of Liability

    3dopenwebsite.com provides its services on an "as is" and "as available" basis. To the fullest extent permitted by applicable EU and Bulgarian law:

    • We make no warranties regarding the uninterrupted or error-free operation of our website or services
    • We are not liable for any indirect, incidental, or consequential damages arising from your use of our website or services
    • Our total liability for any claim shall not exceed the total amount paid by you for the specific service giving rise to the claim
    • We are not responsible for downtime, data loss, or service interruptions caused by third-party hosting providers or factors beyond our reasonable control

    10. Governing Law

    These Terms of Use are governed by and construed in accordance with the laws of the Republic of Bulgaria, as a member state of the European Union. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Sofia, Bulgaria.

    If any provision of these terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

    11. Changes to Terms

    We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting to this page. Your continued use of our website after any modifications constitutes acceptance of the updated terms. We encourage you to review this page periodically.
